REGULAR TOWN BOARD MEETING, March 20, 2024

The regular meeting of the Town Board of the Town of St. Croix Falls was called to order by Chairman Mike Dorsey at 6:00 p.m. on Wednesday, March 20, 2024, at the Town Hall.  Proper notice was given as the agenda was posted at the town hall and on the town’s website March 15, 2024.  The Pledge of Allegiance was said.  Present by roll call were Chairman Mike Dorsey, supervisors Katie Appel, Will Bergmann, Jeremy Hall and Brent Priebe.  Also present was town clerk/treasurer Janet Krueger.  Others in attendance for a portion of the meeting was Patrick Brenholt.

Hall/Bergmann moved to approve the agenda; motion carried. Bergmann/Hall moved to approve the minutes as printed for the February 21, 2024, town board meeting; motion carried.

No public comment was had.

Committee, Commission and Employee Reports: The highway report was reviewed.  Consensus of the Town Board was to have Mr. Jacobs remove the spring weight restriction signs.  Ms. Krueger presented the clerk/treasurer’s report.  Hall/Appel moved to approve payment of vouchers #24-052 through 24-081 amounting to $38,899.32; motion carried on a unanimous roll-call vote, 5-0.  The 2024 year to date budget summaries were reviewed.  Receipts for the period ending February 29, 2024, amounted to $517,674.00, cash balance on February 29, 2024, was $676,558.60.  The building permit and zoning permit logs were reviewed.  No supervisor or chairman reports were given.

New Business:  A request to waive the commercial design guidelines for structures within the Fawn Doe Rosa amusement park where animals are contained was considered.  The waiver request was for a new structure to house reptiles; a new deck and bench area; and reconfiguration of the interactive area (petting area previously) with the removal and addition of structures.  Hall/Bergmann moved to waive the commercial design guidelines for the proposed project; motion carried on a unanimous roll-call vote, 5-0.  Ordinance 24-01 entitled “Amending the Ordinance adopting the Wisconsin Building Codes” was reviewed and the second reading was held.  Bergmann/Hall moved to approve Resolution 24-06 adopting Ordinance 24-01; motion carried on a unanimous roll-call vote, 5-0.

A RESOLUTION ADOPTING ORDIANCE 24-01

AMENDING THE ORDINANCE ADOPTING WISCONSIN BUILDING CODES

WHEREAS the Town Board for the Town of St. Croix Falls has village powers under Section 60.10(2)(c), Stats., that grants police powers as set forth in Section 61.34(1), Stats., to act for the good order of the Town, for its commercial benefit and for the health, safety, and welfare of the public; and

WHEREAS the Town of St. Croix Falls approved an Ordinance Adopting the Wisconsin Building Codes on November 2, 2011, and amended on September 20, 2017; November 18, 2018; May 15, 2019; and June 15, 2022; and

WHEREAS the Ordinance Adopting the Wisconsin Building Codes prohibits non permanent structures; and

WHEREAS the Town Board would like to allow non permanent structures; and

WHEREAS the Town Board held a first reading on February 21, 2024, and a second reading was held on March 20, 2024.

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls, Polk County, Wisconsin, does approve Ordinance 24-01 amending Section 1.7 “Exempt Structures in Wisconsin Administrative Code” of the Ordinance Adopting Wisconsin Building Codes; and

BE IT FURTHER RESOLVED that Ordinance 24-01 become effective upon passage and publication and/or posting according to Wisconsin State Statute.

 

Ordinance 24-01

AMENDING THE ORDINANCE ADOPTING WISCONSIN BUILDING CODES

Section 1:  Purpose

The purpose of this ordinance is to amend 1.7 “Exempt Structures in Wisconsin Administrative Code” to read as follows:

Chapter Comm 21 of the Uniform Dwelling code shall apply to additions, alterations, or new construction of multi-family dwellings, repairs, accessory buildings (over 144 square feet), detached decks, or farm buildings as described in Comm 20.05 of the Wisconsin Administrative code (as amended) within the Town of St. Croix Falls to the extent it is applicable towards those structures.  Notwithstanding the foregoing, The construction or alteration of detached, non-commercial and non-habitable buildings for private use shall not require a building permit. ;  provided, however, no non-permanent structure which is over 144 square feet shall be allowed to be constructed, erected, or placed in the Town of St. Croix Falls without a building permit.  The term “non-permanent structures” shall include, without limitation, structures like plastic sheds, hoop buildings, shipping containers, buildings made of tubular steel, and buildings or sheds covered with fabric or tarp material.  The term “non-permanent structure” does not include preconstructed sheds which have a wood frame construction with at least 2X4 dimensional lumber.

Section 2:  Effective Date

This ordinance shall take effect from and after its passage and legal publication.

Quotes for the 2024 lawn maintenance season were reviewed.  The quotes consisted of ninety dollars ($90) per time for mowing, weed whipping and blow off from All in 1 Property Care LLP and a seasonal rate of one thousand five hundred dollars ($1,500) for weekly cut, trim and blow down from Lake Services Unlimited.  Hall/Appel moved to accept the All in 1 Property Care LLP quote of ninety dollars ($90) per time of mowing, weed whipping and blow off; motion carried on unanimous roll-call vote, 5-0.  A quote was received for two satellite toilets at the Deer Lake boat landing at one hundred thirty dollars ($130) per toilet from Olson Sewer Services and a verbal quote was received of one hundred twenty five dollars ($125) per toilet from Raska Sewer Service.  Bergmann/Hall moved to accept the quote of one hundred thirty dollars ($130) per toilet from Olson Sewer Service; motion carried on a roll-call vote, 4-1 (Yeas:  Bergmann, Hall, Priebe Dorsey; Nays:  Appel).  The 2024 Reimbursement Agreement between the Town and Deer Lake Improvement Association for payroll services and a satellite toilet at the boat landing was reviewed.  Appel/Hall moved to adopt Resolution 24-07 approving the Reimbursement Agreement with Deer Lake; motion carried on a unanimous roll-call vote, 5-0.

A RESOLUTION APPROVING THE 2024 REIMBURSEMENT AGREEMENT WITH THE DEER LAKE IMPROVEMENT ASSOCIATION FOR THE DEER LAKE INTERN POSITION(S) AND PORTABLE TOILET AT DEER LAKE BOAT LANDING

WHEREAS, the Deer Lake Improvement Association has received an Invasive Species Education and Protection grant under the Clean Boats, Clean Waters program to conduct certain educational and prevention programs at Deer Lake; and

WHEREAS, the Deer Lake Improvement Association desires to avoid the expense and inconvenience of directly hiring the interns and managing payroll and other activities associated with paying the interns who will conduct the grant activities; and

WHEREAS, the Town of St. Croix Falls has the capability to hire the interns and provide payroll services; and

WHEREAS, the Deer Lake Improvement Association would like the Town of St. Croix Falls share the cost of the two portable toilets rented for the boat landing from April thru October.

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls, Polk County, Wisconsin, will provide payroll services for the Deer Lake Clean Boats, Clean Waters program in accordance with the 2024 Reimbursement Agreement Between the Deer Lake Improvement Association and the Town; and

BE IT FURTHER RESOLVED that the 2024 Reimbursement Agreement between the Deer Lake Improvement Association and the Town be effective upon signing and become part of this enacting resolution.

Reimbursement Agreement

Between Deer Lake Improvement Association and

the Town of St. Croix Falls

For the Deer Lake Intern Position and

Portable Toilet at the Deer Lake Boat Landing

            This REIMBURSEMENT AGREEMENT (“Agreement”) is made and entered into effective as of this 1st day of April, 2024 (“Effective Date”) by and between the Town of St. Croix Falls, Wisconsin (“Town”) and the Deer Lake Improvement Association (“Association”).

WHEREAS, the Association has received an Invasive Species Education and Protection grant (“Grant”) under the Clean Boats Clean Waters program in order to conduct certain educational and prevention programs at Deer Lake (“Grant Activities”);

WHEREAS, the Association will use the Grant funds to, among other things, reimburse the Town, which will hire interns to conduct the Grant Activities;

WHEREAS, the Association desires to avoid the expense and inconvenience of directly hiring the interns and managing payroll and other activities associated with paying the interns who will conduct the Grant Activities (“Services”);

WHEREAS, the Town has the capability to hire the interns and provide the Services;

WHEREAS, the Association desires the Town to hire the interns and provide the Services and the Town is willing to hire the interns and provide the Services upon the terms and conditions set forth in this Agreement;

NOW, THEREFORE, in consideration of the matters set forth above, the promises made by the parties herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged by the parties, the parties agree as follows:

  1. Employment of Interns. The Town agrees that unless such employment is earlier terminated by the Town (at its discretion), during the Term (as hereinafter defined), the Town will employ the interns to conduct the Grant Activities; provided, however, it is acknowledged and agreed that this Agreement is not, and does not constitute, an employment agreement between the Town and any such intern.
  2. Provision of Services. During the Term of this Agreement, the Town agrees to provide the Services to the Association upon the terms and conditions set forth in this Agreement.
  3. Term and Termination. The term (“Term”) of this Agreement shall commence on the Effective Date and shall end upon the earlier of (a) the date on which the Association is no longer conducting the Grant Activities during the summer of 2024; or (b) October 31, 2024.  Either party may terminate this Agreement upon ten (10) days prior written notice to the other party.  The Association’s payment obligations under Section 4 below, the acknowledgement and agreement of the Association set forth in Section 4 below and the Indemnification set forth in Section 5 below shall all survive the termination or expiration of this Agreement.
  4. Payment for the Services. The Association shall pay the Town for providing the Services in an amount equal to $34.00 per hour of time spent by Town personnel providing the Services.  In addition, the Association shall provide to the Town no later than thirty (30) days from invoice date for the amounts sufficient to pay all interns their wage for that pay period and all taxes and other expenses related to such payment.  The Association shall reimburse the Town for all reasonable costs and expenses incurred by the Town in connection with providing the Services, including any increase in the Town’s insurance expense related to the this Agreement.  In addition, the Association shall provide to the Town no later than thirty (30) days from invoice date the rental fee for one of the two portable toilets rented for the boat landing for the months of April thru October.
  5. Indemnification. The Association agrees to indemnify, defend and hold the Town and its officers, board members, employees, agents, representatives and contractors (“Indemnified Parties”) harmless from and against any loss, cost, expense, fee, liability, proceeding, litigation (including attorneys fees and costs) incurred or suffered by any of the Indemnified Parties arising from, or relating to, this Agreement, the Town’s employment of the interns, the Services provided under this Agreement, and/or the conduct by the Association of the Grant Activities.
  6. Governing Law. This Agreement shall be governed by, and construed in accordance with, the internal laws of the State of Wisconsin applicable to contracts executed and fully performed within the State of Wisconsin, without regard to the conflicts of laws provisions thereof.
  7. Counterparts. This Agreement may be executed in counterparts, all of which shall be considered one and the same agreement and shall become effective when such counterparts have been signed by each of the parties and delivered to the other parties, it being understood that all parties need not sign the same counterpart.

Resolution 24-08

A RESOLUTION APPROVING A SECONDHAND ARTICLE DEALER/SECONDHAND JEWELRY DEALER LICENSE

FOR THE YEAR ENDING DECEMBER 31, 2024 – ANDERSON RECYCLING

WHEREAS Wisconsin Statutes 134.71 requires the licensing of secondhand article and secondhand jewelry dealers to be by the local municipality, and

WHEREAS Rhonda Anderson doing business as Anderson Recycling at 1930 US Hwy 8, St. Croix Falls, Wisconsin, has made application for a license under the provisions of Wis.Stats. 134.71; and

WHEREAS the required license fee as specified in Statutes, has been received and deposited with the Town Treasurer; and

WHEREAS a criminal history check had been conducted pursuant to Wis.Stats.134.71(6);

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls approves the license application of Rhonda Anderson dba Anderson Recycling, 1930 US Hwy 8, St. Croix Falls, Wisconsin; and

BE IT FURTHER RESOLVED that the Town Clerk be authorized to issue a secondhand article dealer/secondhand jewelry dealer license to the same for the year ending December 31, 2024.

 

Building inspector Ben Campbell submitted a request to amend the building permit fees.  Appel/Bergmann moved to adopt Resolution 24-09 amending the fee schedule; motion carried on a unanimous roll-call vote, 5-0.

A RESOLUTION AMENDING THE SCHEDULE OF FEES

FOR THE TOWN OF ST. CROIX FALLS

WHEREAS the Town Board for the Town of St. Croix Falls has village powers under Section 60.10(2)(c), Stats., that grants police powers as set forth in Section 61.34(1), Stats., to act for the good order of the Town, for its commercial benefit and for the health, safety, and welfare of the public; and

WHEREAS the Town Board on March 16, 2011, by means of Resolution 11-05 did adopt an ordinance entitled “Fee Ordinance for the Town of St. Croix Falls”; and

WHEREAS the Town Board wishes to act in good order for the health, safety, and welfare of the public by establishing a schedule of fees.

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls, Polk County, Wisconsin, does hereby create a fee schedule entitled:

BE IT FURTHER RESOLVED that this schedule replaces any past fee schedules and shall become effective upon passage and posting thereof.

Terms of the fire agreement are still being negotiated between the City and the Town so no discussion was had.

Closing public comment:  Mr. Brenholt stated he is still available as a back up to the highway maintenance employee when needed.

The chairman read the call for a closed session per Wisconsin State Statue 19.85(1) (c) for an annual employee performance review.  Bergmann/Hall moved to adjourn to closed session at 6:51 p.m. per Wisconsin Statute 19.85 (1) (c) for an annual employee performance review; motion carried on a unanimous roll-call vote, 5-0.

The Town Board reconvened in open session at 7:23 p.m. with the board members present.

The board announced an annual performance review was conducted for the appointed clerk/treasurer.

There being no further business, Hall/Bergmann moved to adjourn the meeting; motion carried and the meeting was adjourned at 7:27 p.m.
