REGULAR TOWN BOARD MEETING, April 17, 2024

The regular meeting of the Town Board of the Town of St. Croix Falls was called to order by Chairman Mike Dorsey at 6:00 p.m. on Wednesday, April 17, 2024, at the Town Hall.  Proper notice was given as the agenda was posted at the town hall and on the town’s website April 12, 2024.  The Pledge of Allegiance was said.  Present by roll call were Chairman Mike Dorsey, supervisors Katie Appel, Will Bergmann, Jeremy Hall and Brent Priebe.  Also present was town clerk/treasurer Janet Krueger, public works employee Steve Jacobs and legal counsel Adam Jarchow.  Others in attendance were Kyle Yunker, Doug Skaug, Brad Nygren and Peter Trinh.

Appel/Hall moved to approve the agenda; motion carried. Appel/Hall moved to approve the minutes as printed for the March 20, 2024, town board meeting; motion carried.

No public comment was had.

Committee, Commission and Employee Reports: Mr. Jacobs presented the highway report.  Ms. Krueger presented the clerk/treasurer’s report.  Hall/Bergmann moved to approve payment of vouchers #24-082 through 24-105 amounting to $23,411.92; motion carried on a unanimous roll-call vote, 5-0.  The 2024 year to date budget summaries were reviewed.  Receipts for the period ending March 31, 2024, amounted to $807.19, cash balance on March 31, 2024, was $641,490.62.  The April 10, 2024, plan commission minutes and building permit and zoning permit logs were reviewed.  No supervisor or chairman reports were given.

New Business:  A request for transient lodging at 1366 190th Street was presented.  Hall/Appel moved to adopt Resolution 24-10 granting a special exception to Peter Trinh for transient lodging at 1366 190th Street; motion carried on a unanimous roll-call vote, 5-0.

Resolution 24-10

A RESOLUTION GRANTING A SPECIAL EXCEPTION TO PETER TRINH FOR TRANSIENT LODGING

IN THE TRANSITIONAL DISTRICT

WHEREAS property owner Peter Trinh has filed an application with the Town of St. Croix Falls for transient lodging at 1366 190th Street, located in the SE ¼ of NE ¼ of Section 26, T34N, R18W, and identified as Tax Parcel #044-00697-0100; and

WHEREAS Chapter III, Section C, 5. Transitional District, f. (20) transient lodging requires a Special Exception; and

WHEREAS per Chapter I, Section I, 3, (b) the Plan Commission did conduct a public hearing on the matter and did recommend approval on April 10, 2024, for the special exception with conditions for transient lodging at 1366 190th Street in the SE ¼ of NE ¼ of Section 26.

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls, Polk County, Wisconsin, does hereby concur with the Town Plan Commission to grant a special exception to Peter Trinh for transient lodging at 1366 190th Street, located in the SE ¼ of NE ¼ of Section 26 and identified as tax parcel number #044-00697-0100 subject to the following conditions:

  1. Up to eight people allowed from 11:00 pm to 7:00 am with a maximum of thirty occupants are allowed from 7:00 am to 11:00 pm regardless of the number of bedrooms;
  2. Accessory building must not have sleeping accommodations;
  3. No RVs or campers allowed for overnight stay;
  4. All parking to be on an impervious surface and must be contained on the property;
  5. Applicant must obtain all proper licensing;
  6. All fires and embers are to be extinguished by 11:00 pm, with no unattended fires;
  7. No fireworks are allowed.
  8. Applicant must have 24 hour contact number available to the public;
  9. Property must remain free from citation and charges for nuisance, disorderly conduct, or any other illegal activity;
  10. Quiet hours shall be imposed from 11:00 pm to 7:00 am;
  11. Applicant and renters must comply with all applicable laws and regulations:
  12. Department of natural resources lake regulations to be included in rental information,
  13. Lake association rules to be included in rental information, and
  14. No fireworks are allowed must be included in rental information.
  15. All pets must be contained on the rental property unless they are on public property;
  16. All conditions that apply to renters shall be included in rental information;
  17. Owner is to provide the town with any new or revised house rules and regulations for renters;
  18. The special exception shall terminate upon the sale or transfer of ownership of either the parcel of land or the business itself;
  19. Any formal complaint lodged against the use in the first year of operation will lead to an automatic review of the special exception by the plan commission and/or town board at the next possible meeting;
  20. The business will obey all laws and maintain all proper licenses and permits; and
  21. All conditions relating to rental property in Chapter I, Section I of the zoning ordinance shall apply.

BE IT FURTHER RESOLVED that this special exception is conditioned on the applicants obtaining the necessary and required permits, if any, from Polk County and various agencies of the State of Wisconsin; and

BE IT FURTHER RESOLVED that this special exception must be exercised by application for the necessary permits within twelve (12) months of the date of this Resolution.

A request for transient lodging at 1368 190th Street was presented.  Bergmann/Hall moved to adopt Resolution 24-11 granting a special exception to Peter Trinh for transient lodging at 1368 190th Street; motion carried on a unanimous roll-call vote, 5-0.

Plans were presented for a storage structure at 1971 US Highway 8 for compliance with the commercial design guidelines.  Hal/Appel moved to adopt Resolution 24-12 approving the commercial design site plan for a storage structure at 1971 US Highway 8; motion carried on a unanimous roll-call vote, 5-0.

Resolution 24-12

A RESOLUTION APPROVING COMMERCIAL DESIGN SITE PLAN FOR

 1971 US HIGHWAY 8, TAX PARCEL #044-00714-0000, SEC. 26

WHEREAS Doug Skaug submitted a commercial design site plan for the property located at 1971 US Highway 8, located in the SE ¼ of SW ¼ of Section 26, T34N, R18W, and identified as Tax Parcel No. 044-00714-0000, and

WHEREAS Chapter III, Section C, 3. Commercial District, a. All new commercial development and commercial development involving a structural alteration, addition, or repair to a structure that exceeds seventy-five (75%) percent of the equalized assessed value of the structure over a two year period shall be subject to the Town Commercial Design Guidelines as set forth in Section F of this Chapter III including site plan review and shall not be allowed unless recommended by the Plan Commission and approved by the Town Board; and

WHEREAS the Plan Commission did conduct a public hearing on the matter and did recommend approval of the site plan as proposed on April 10, 2024.

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls, Polk County, Wisconsin, does hereby concur with the Town Plan Commission and approves the commercial design site plan as proposed 22’ x 26’ go kart storage structure on the property located at 1971 US Highway 8, located in the SE ¼ of SW ¼ Section of 26, T34N, R18W and identified as Tax Parcel No. 044-00714-0000.

Hall/Bergmann moved to adopt Resolution 24-13 appointing Kyle Yunker as an alternate to the Board of Review; motion carried on a unanimous roll-call, vote, and 5-0.

Resolution 24-13

 A RESOLUTION APPOINTING ALTERNATE MEMBERS TO

THE BOARD OF REVIEW FOR THE TOWN OF ST. CROIX FALLS

WHEREAS one of the changes to Wisconsin Statute Section 70.47 authorized the removal of Board of Review members for individual cases under specific circumstances, and

WHEREAS Section 70.47 (6m)(c) authorizes the appointment of alternate members to serve on the Board of Review when standing members are removed from individual cases, and

WHEREAS a standing member of the Board of Review may voluntarily remove himself/herself due to a possible conflict of interest or unable to serve for any other reason;

THEREFORE BE IT RESOLVED that the Town Board for the Town of St. Croix Falls, pursuant to Wisconsin Statute section 70.47 (6m)(c) and Section 70.46 (1), hereby appoints the following elector of the Town of St. Croix Falls as an alternate Board of Review member:

Alternate 1:  Kyle Yunker

BE IT FURTHER RESOLVED that this appointment be effective immediately and run through the Monday before the third Tuesday of April 2025.

BE IT FURTHER RESOLVED that the Town Board of the Town of St. Croix Falls authorizes the per diem for the alternate members attending the Board of Review be set at eight dollars ($8.00) per hour.

The annual dues statement from Wisconsin Towns Association was presented.  Appel/Bergmann moved to approve the 2024-2025 annual WTA dues in the amount of one thousand, one hundred eleven dollars and 25 cents ($1,116.25); motion carried on a unanimous roll-call vote, 5-0.  The Behavior of Animal ordinance was reviewed for potential amendments.  The first reading of proposed amendments will take place at next month’s board meeting.  The zoning ordinance was reviewed to see if language existed for the Farmland Preservation Law.  The amended map for the St. Croix Falls fire district was reviewed.  Appel/Bergmann moved to approve the amended St. Croix Falls Fire District map as presented with the addition of Section 13; motion carried on a unanimous roll-call vote, 5-0.  A quote for weed spraying of invasive species in the road right of ways on the west half of the town was presented.  Appel/Hall moved to approve weed spraying of the west half of the Town; motion carried on a unanimous roll-call vote, 5-0.

Closing public comment:  Mr. Nygren inquired when 125th Avenue was going to be completed.

There being no further business, Hall/Bergmann moved to adjourn the meeting; motion carried and the meeting was adjourned at 7:03 p.m.
