REGULAR TOWN BOARD MEETING, June 21, 2023
The regular meeting of the Town Board of the Town of St. Croix Falls was called to order by Chairman Mike Dorsey at 6:00 p.m. on Wednesday, June 21, 2023, at the Town Hall.  Proper notice was given as the agenda was posted at the town hall and on the town’s website June 16, 2023.  The Pledge of Allegiance was said.  Present by roll call were Chairman Mike Dorsey, supervisors Katie Appel, Will Bergmann, Jeremy Hall and Sharon Kelly.  Also present were town clerk Janet Krueger, public works employee Steve Jacobs and legal counsel Adam Jarchow.  Others in attendance were Tim Libertini, Rachel Lukasik, Mark Thayer, Monarch Paving representative and Fahrner Asphalt Sealers representative.  Kelly/Appel moved to approve the agenda; motion carried. Appel/Hall moved to approve the minutes as printed for the May 17, 2023, town board meeting; motion carried.

Public comment – Mark Thayer inquired if the town will receive a copy of the State permit issued for the transient lodging at 1358 Northpoint Road.

Committee, Commission and Employee Reports: Mr. Jacobs gave the highway report.  Ms. Krueger presented the clerk/treasurer’s report.  Receipts for the period ending May 31, 2023, amounted to $9,423.42, cash balance on May 31, 2023, was $570,934.15.  Bergmann/Appel moved to approve payment of vouchers #23-130 through #23-157 amounting to $64,226.42; motion carried on a unanimous roll-call vote, 5-0.  The 2023 year to date budget summaries were reviewed.  The planning commission minutes and zoning permit logs were reviewed.  There were no supervisor or chairman reports.

New Business:  A special exception request for transient lodging at 1358 Northpoint Road was presented.  Hall/Bergmann moved to adopt Resolution 23-17 granting a special exception for transient lodging to Timothy Libertini.  Hall/Appel moved to amend Resolution 23-17 by deleting the “maximum rental of up to 180 days per calendar year” condition; motion carried on a roll-call vote, 3-2 (Yeas:  Appel, Hall, Dorsey; Nays:  Bergmann, Kelly).  Hall/Katie moved to amend Resolution 23-17 by deleting “with a maximum of twelve occupants are allowed from 7:00 am to 11:00 pm regardless of the number of bedrooms”; motion was withdrawn.  Hall/Bergmann moved to amend Resolution 23-17 by changing the number of occupants allowed 7:00 am to 11:00 pm from twelve to thirty; motion carried on a roll-call vote, 4-1 (Yeas:  Appel, Bergmann, Hall, Dorsey; Nays:  Kelly).  Hall/Appel moved to amend Resolution 23-17 by deleting “owner is responsible to state and local jurisdictions for compliance with firework regulations” and adding “no fireworks allowed”; motion carried on a roll call vote, 3-2 (Yeas:  Appel, Bergmann, Hall; Nays:  Kelly, Dorsey).  Bergmann/Appel moved to amend Resolution 23-17 by changing the time for fires to be extinguished from 11:00 pm to 10:00 pm and the quiet hours to 10:00 pm to 8:00 am from 11:00 pm to 7:00 am; motion failed on a roll-call vote, 2-3 (Yeas:  Bergmann, Kelly; Nays:  Appel, Hall, Dorsey).  Appel/Bergmann moved to amend Resolution 23-17 with a condition that the owner provide the town with any new or revised house rules and regulations; motion carried on a unanimous roll call vote, 5-0.  Motion carried passing the amended Resolution 23-17 on a roll-call vote, 4-1 (Yeas:  Appel, Bergmann, Hall, Dorsey; Nays:  Kelly).

Resolution 23-17

A RESOLUTION GRANTING A SPECIAL EXCEPTION

TO TIMOTHY LIBERTINI FOR TRANSIENT LODGING

IN THE RESIDENTIAL DISTRICT

WHEREAS property owner Timothy Libertini has filed an application with the Town of St. Croix Falls for transient lodging at 1358 Northpoint Road, located in the NE ¼ of NW ¼ of Section 25, T34N, R18W, and identified as Tax Parcel #044-00620-0000; and

WHEREAS Chapter III, Section C, 5. Transitional District, f. (12) transient lodging requires a Special Exception; and

WHEREAS per Chapter I, Section I, 3, (b) the Plan Commission did conduct a public hearing on the matter and did recommend approval on June 14, 2023, for the special exception with conditions for transient lodging at 1358 Northpoint Road in the NE ¼ of NW ¼ of Section 25.

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls, Polk County, Wisconsin, does hereby concur with the Town Plan Commission to grant a special exception to Timothy Libertini for transient lodging at 1358 Northpoint Road, located in the NE ¼ of NW ¼ of Section 25 and identified as tax parcel number #044-00620-0000 subject to the following conditions:

  1. Up to eight people allowed from 11:00 pm to 7:00 am with a maximum of thirty occupants are allowed from 7:00 am to 11:00 pm regardless of the number of bedrooms;
  2. Accessory building must not have sleeping accommodations;
  3. No RVs or campers allowed for overnight stay;
  4. All parking to be on an impervious surface and must be contained on the property;
  5. Applicant must obtain all proper licensing;
  6. All fires and embers are to be extinguished by 11:00 pm, with no unattended fires;
  7. Applicant must have 24 hour contact number available to the public;
  8. Property must remain free from citation and charges for nuisance, disorderly conduct, or any other illegal activity;
  9. Quiet hours shall be imposed from 11:00 pm to 7:00 am;
  10. Applicant and renters must comply with all applicable laws and regulations:
  11. Department of natural resources lake regulations to be included in rental information,
  12. Lake association rules to be included in rental information, and
  13. No fireworks are allowed;
  14. All pets must be contained on the rental property unless they are on public property;
  15. All conditions that apply to renters shall be included in rental information;
  16. Owner is to provide the town with any new or revised house rules and regulations for renters;
  17. Existing septic system to be inspected and approved for three bedrooms;
  18. The special exception shall terminate upon the sale or transfer of ownership of either the parcel of land or the business itself;
  19. Any formal complaint lodged against the use in the first year of operation will lead to an automatic review of the special exception by the plan commission and/or town board at the next possible meeting;
  20. The business will obey all laws and maintain all proper licenses and permits; and
  21. All conditions relating to rental property in Chapter I, Section I of the zoning ordinance shall apply.

BE IT FURTHER RESOLVED that this special exception is conditioned on the applicants obtaining the necessary and required permits, if any, from Polk County and various agencies of the State of Wisconsin; and

BE IT FURTHER RESOLVED that this special exception must be exercised by application for the necessary permits within twelve (12) months of the date of this Resolution.

Kelly/Bergmann moved to adopt Resolutions 23-18, Resolution 23-19, and Resolution 23-20 approving the alcohol beverage licenses, cigarette/tobacco licenses, and operator licenses; motion carried on a unanimous roll-call vote, 5-0.

Resolution 23-18

A RESOLUTION APPROVING ALCOHOL BEVERAGE LICENSES

FOR THE YEAR ENDING JUNE 30, 2024

WHEREAS the individuals, partnerships and corporations listed below have made application to the Town Clerk requesting alcohol beverage licenses pursuant to Chapter 125 of the Wisconsin Statutes for the year ending June 30, 2024; and

WHEREAS the applications appear to be complete and the required fee has been paid; and

WHEREAS publication of notice appeared in the Inter-County Leader on June 14, 2023, and was posted at the Town Hall and on the town’s website on June 14, 2023, per Wisconsin State Statutes 125.04(3)(g).

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls does approve and grant alcohol beverage licenses for the year ending June 30, 2024, to the named individuals, partnerships and corporations as follows:

FOR THE YEAR ENDING JUNE 30, 2024

WHEREAS the individuals, partnerships, and corporations listed below have made application to the Town Clerk requesting cigarette and tobacco licenses pursuant to Section 134.65 of the Wisconsin Statutes for the year ending June 30, 2024; and

WHEREAS the applications appear to be complete and the required fee has been paid.

A fireworks permit application was presented for July 4, 2023, at Big Rock Creek.  Appel/Hall moved to approve the fireworks display at Big Rock Creek on July 4, 2023; motion carried.

Bergmann/Hall moved to adopt Resolution 23-21 appointing Rick Katzmark and Kevin Rector to the plan commission; motion carried on a unanimous roll-call vote, -0.

Resolution 23-21

A RESOLUTION APPOINTING RICK KATZMARK AND KEVIN RECTOR AS REGULAR PLAN COMMISSION MEMBERS

ON THE TOWN OF ST. CROIX FALLS PLAN COMMISSION

WHEREAS the terms of regular plan commission members Rick Katzmark and Kevin Rector expire on June 30, 2023; and

WHEREAS the Town Chairperson has re-nominated Rick Katzmark and Kevin Rector as “regular members” of the plan commission for another three year term expiring June 30, 2026.

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls, Polk County, Wisconsin, appoints to the Town of St. Croix Falls Plan Commission

Rick Katzmark as a regular member with a term ending June 30, 2026; and

Kevin Rector as a regular member with a term ending June 30, 2025.

Appel/Hall moved to adopt Resolution 23-22 appointing Joel Yunker to the board of adjustments; motion carried on a unanimous roll-call vote, 5-0.

Resolution 23-22

A RESOLUTION APPOINTING MEMBERS

TO THE BOARD OF ADJUSTMENT

FOR THE TOWN OF ST. CROIXFALLS

WHEREAS, two regular member terms will be expiring June 30, 2023, in which Joel Yunker holds one of these terms and the other is vacant; and

WHEREAS, the Town Chairperson has re nominated Joel Yunker as a “regular members” to the Board of Adjustment for the term expiring June 30, 2026.

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls, Polk County, Wisconsin, confirms the nominations and appoints to the Town of St. Croix Falls Board of Adjustment

Joel Yunker as a regular member with a term ending June 30, 2026.

BE IT FURTHER RESOLVED that the term for Joel Yunker begin July 1, 2023.

Bids received for the 2023 road work are:  $15,855.00 for mastic and crack sealing from Seal Tech; $27,656.00 for mastic and crack sealing, $46,135.00 for double chip seal with CRS #2 oil, $47,497.00 for double chip seal with CRS #2P oil from Fahrner Asphalt Sealers; $48,558.60 for pulverizing 180th Avenue, 180th Street, 160th Avenue and 125th Avenue from SB Madison Construction; and $273,143.00 for  warm mix asphalt on 160th Avenue, $271,902.00 for hot mix asphalt on 160th Avenue, $19,826.00 warm mix asphalt wedge overlay, $19,754.00 hot mix asphalt wedge and overlay and $40,315.00 for pulverizing 180th Avenue, 180th Street, 160th Avenue and 125th Avenue from Monarch Paving.  Kelly/Hall moved to approve Fahrner for double chip seal over gravel CRS #2P oil; Monarch Paving warm mix asphalt for wedge and overlay, warm mix asphalt starting at State Road 87 and east on 160th Avenue for 1 and ¼ miles, and pulverizing 180th Avenue, 180th Street, 160th Avenue and 125th Avenue; motion carried on a unanimous roll-call vote, 5-0.  Chairman Dorsey thanked Supervisor Sharon Kelly for her years of service to the Town and presented her with a “Certificate of Appreciation”.  Bergmann/Hall moved to adopt Resolution 23-23 appointing Brent Priebe as Town Board Supervisor; motion carried on a roll-call vote, 5-0.

Resolution 23-23

 A RESOLUTION APPOINTING BRENT PRIEBE TO FILL THE VACANCY OF

TOWN BOARD SUPERVISOR FOR THE TOWN OF ST. CROIX FALLS

WHEREAS Sharon Kelly’s last day as a town board supervisor is June 21, 2023, due to moving out of the municipality leaving her position of Town Board Supervisor vacant; and

WHEREAS Town Chairman has nominated Brent Priebe to fill the vacant town board supervisor position with a term expiring April 14, 2025.

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls, Polk County, Wisconsin, hereby appoints Brent Priebe to the office of Town Board Supervisor to fill the vacancy of town board supervisor effective June 22, 2023, for the residual of the unexpired term.

Hall/Bergmann moved to approve the purchase of a hot box in the amount of $500.00 from the City of St. Croix Falls; motion carried on a unanimous roll-call vote, 5-0.

Closing public comments – Steve Jacobs thanked Sharon Kelly and stated he has enjoyed working with her.

The next town board meeting is scheduled for July 19, 2023.  There being no further business, Bergmann/Kelly moved to adjourn the meeting; motion carried and the meeting was adjourned at 7:45 p.m.
