PLAN COMMISSION MEETING, August 14, 2024
The regular meeting of the Town Plan Commission for the Town of St. Croix Falls was called to order by Chairman Mike Dorsey at 6:00 p.m. on Wednesday, August 14, 2024, at the Town Hall.  Proper notice was given as the notice was published in the July 31, 2024, and August 7, 2024, editions of the Inter County Leader.  The agenda was posted at the town hall and on the town’s website August 8, 2024.  The Pledge of Allegiance was said.  Present by roll call were Chairman Mike Dorsey, members Jeremy Appel, Dave Berg, Stacy Bergmann, Rick Katzmark and Kevin Rector.  Also present were town clerk Janet Krueger and legal counsel Adam Jarchow.  Others present were Sarah Olson, Kevin and Carole Baumgart, and Kyle Yunker.

Katzmark/Rector moved to approve the agenda; motion carried.  Katzmark/Rector moved to approve the June 12, 2024, meeting minutes; motion carried.

No public comment was had.

Public Hearing – Special Exception request for transient lodging at 1350 190th Street.  The public hearing opened at 6:04 p.m.  Ms. Baumgart expressed concern about the number of transient lodgings located in the neighborhood and how they conflict with existing residential homes; concerned about the thirty (30) people occupancy allowed during day hours; and requested quiet hours be 10:00 pm to 8:00 am.  Mr. Baumgart requested that a maximum of 12 guest during day hours; that no fire arms be allowed; that a privacy fence be placed on his neighbors side of the house; that a sound barrier be in the fire place room and a sound barrier be placed around the whirl pool.

Ms. Olson addressed the concerns and explained her intentions.  The public hearing closed at 6:26 p.m.

Katzmark/Berg moved to recommend Town Board approval of the special exception request for transient lodging at 1350 190th Street with the following conditions:

  • Up to eight people allowed from 11:00 pm to 7:00 am with a maximum of twelve occupants are allowed from 7:00 am to 11:00 pm regardless of the number of bedrooms;
  • Accessory building must not have sleeping accommodations;
  • No RVs or campers allowed for overnight stay;
  • All parking to be on an impervious surface and must be contained on the property;
  • Applicant must obtain all proper licensing;
  • All fires and embers are to be extinguished by 11:00 pm, with no unattended fires;
  • No fireworks are allowed;
  • Applicant must have 24 hour contact number available to the public;
  • Property must remain free from citation and charges for nuisance, disorderly conduct, or any other illegal activity;
  • Quiet hours shall be imposed Sunday through Thursday from 10:00 pm to 8:00 am and Friday and Saturday from 11:00 am to 7:00 am;
  • Applicant and renters must comply with all applicable laws and regulations:
  • Department of natural resources lake regulations to be included in rental information,
  • Lake association rules to be included in rental information, and
    • No fireworks are allowed must be included in rental information;
  • All pets must be contained on the rental property unless they are on public property;
  • All conditions that apply to renters shall be included in rental information;
  • Owner is to provide the town with any new or revised house rules and regulations for renters;
  • The special exception shall terminate upon the sale or transfer of ownership of either the parcel of land or the business itself;
  • Any formal complaint lodged against the use in the first year of operation will lead to an automatic review of the special exception by the plan commission and/or town board at the next possible meeting;
  • The business will obey all laws and maintain all proper licenses and permits; and
  • All conditions relating to rental property in Chapter I, Section I of the zoning ordinance shall apply;

in addition the applicant is to supply to the town board the house rules and regulations before the town board meeting; motion carried on a unanimous roll-call vote, 6-0.

Closing public comment:  Mr. Baumgart expressed concern about the outdoor speakers and requested they not be allowed.

There being no further business, Katzmark/Rector moved to adjourn the meeting; motion carried and the meeting was adjourned at 6:33 p.m.
