PLAN COMMISSION MEETING, June 14, 2023
The regular meeting of the Town Plan Commission for the Town of St. Croix Falls was called to order by Chairman Mike Dorsey at 6:00 p.m. on Wednesday, June 14, 2023, at the Town Hall. Proper notice was given as the notice was published in the May 31, 2023, and June 7, 2023, editions of the Inter County Leader and the agenda was posted at the town hall and on the town’s website June 9, 2023. The Pledge of Allegiance was said. Present by roll call were Chairman Mike Dorsey, members Jeremy Appel, Rick Katzmark and Kevin Rector. Member Gus Koecher arrived at 6:03 pm. Absent were Dave Berg, Stacy Bergmann, and Kyle Yunker. Also present were town clerk Janet Krueger, zoning administrator Ben Campbell and legal counsel Adam Jarchow. Others present were Rachel Lukasik, Tim Libertini, Pat & Sandy Corcoran, Dave Libertini, Brad & Sue Wendel, Mark Thayer and Time Dummer.
Katzmark/Rector moved to approve the agenda; motion carried. Rector/Katzmark moved to approve the May 10, 2023, meeting minutes; motion carried.
No public comment was had.
Public Hearing – Special Exception for transient lodging at 1853 Northpoint Road.
The public hearing opened at 6:04 p.m. The applicants provided information on their home and went over their manual for renters. Members of the public had questions on the rules, regulation and approval process for transient lodging and expressed concern over the current septic, potential noise issues, parking issues on the private road and enforcement of conditions. The public hearing closed at 6:30 p.m.
Katzmark/Rector moved to recommend town board approval for the transient lodging at 1358 Northpoint Road with the following conditions:
- Up to eight people allowed from 11:00 pm to 7:00 am with a maximum of twelve occupants are allowed from 7:00 am to 11:00 pm regardless of the number of bedrooms;
- Maximum rental of up to 180 days per calendar year;
- Accessory building must not have sleeping accommodations;
- No RVs or campers allowed for overnight stay;
- All parking to be on an impervious surface and must be contained on the property;
- Applicant must obtain all proper licensing;
- All fires and embers are to be extinguished by 11:00 pm, with no unattended fires;
- Applicant must have 24 hour contact number available to the public;
- Property must remain free from citation and charges for nuisance, disorderly conduct, or any other illegal activity;
- Quiet hours shall be imposed from 11:00 pm to 7:00 am;
- Applicant and renters must comply with all applicable laws and regulations:
- Department of natural resources lake regulations to be included in rental information,
- Lake association rules to be included in rental information, and
- Owner is responsible to state and local jurisdictions for compliance with firework regulations.
- All pets must be contained on the rental property unless they are on public property;
- All conditions that apply to renters shall be included in rental information;
- Existing septic system to be inspected for three bedrooms;
- Local uniform building inspector shall be hired by the applicant to determine the number of legal bedrooms in the dwelling;
- The special exception shall terminate upon the sale or transfer of ownership of either the parcel of land or the business itself;
- Any formal complaint lodged against the use in the first year of operation will lead to an automatic review of the special exception by the plan commission and/or town board at the next possible meeting;
- The business will obey all laws and maintain all proper licenses and permits;
- All conditions relating to rental property in Chapter I, Section I of the zoning ordinance shall apply.
Katzmark/Koecher moved to amend the motion by striking the condition “local uniform building inspector shall be hired by the applicant to determine the number of legal bedrooms in the dwelling”; motion carried on a unanimous roll-call vote, 5-0. The amended motion carried on a unanimous roll-call vote, 5-0.
Closing public comment: Ms. Corcoran and Ms. Wendel requested clarification of quiet hours. Mr. Thayer inquired why the quiet hours of 11:00 p.m. to 7:00 a.m. were not amended to 10:00 p.m. to 8:00 a.m.; and stated he does not understand why when a residence is becoming a commercial site the condition for the building inspector to perform an inspection was removed.
There being no further business, Katzmark/Rector moved to adjourn the meeting; motion carried and the meeting was adjourned at 6:57 p.m.
