REGULAR TOWN BOARD MEETING, December 18, 2024

The regular meeting of the Town Board of the Town of St. Croix Falls was called to order by Chairman Mike Dorsey at 6:00 p.m. on Wednesday, December 18, 2024, at the Town Hall.  Proper notice was given as the agenda was posted at the town hall and on the town’s website December 13, 2024.  The Pledge of Allegiance was said.  Present by roll call were chairman Mike Dorsey, supervisors Will Bergmann, Jeremy Hall and Brent Priebe.  Supervisor Katie Appel was absent.  Also present were town clerk/treasurer Janet Krueger, public works employee Steve Jacobs and legal counsel Adam Jarchow.

Bergmann/Hall moved to approve the agenda; motion carried. Hall/Bergmann moved to approve the minutes as printed for the November 20, 2024, town board meeting; motion carried.

No public comment was had.

Committee, Commission and Employee Reports: Mr. Jacobs gave the highway report.  Ms. Krueger presented the clerk/treasurer’s report.  Bergmann/Priebe moved to adopt Resolution 24-37 amending the 2024 Budget; motion carried on a unanimous roll-call vote, 4-0.

A RESOLUTION TO AMEND THE 2024 BUDGET

FOR THE TOWN OF ST. CROIX FALLS

WHEREAS year-to-date, the Dog Control Expense Account has a deficit of $515.25 creating a deficit in the Health and Human Services category.

THEREFORE the Town Board of the Town of St. Croix Falls, Polk County does hereby resolve and order as follows:

That the sum of $600.00 is hereby transferred from the Contingencies Account to the Dog Control Expense Account.

 

Hall/Bergmann moved to approve payment of vouchers #24-304 through 24-331 amounting to $25,901.55; motion carried on a unanimous roll-call vote, 4-0.  The 2024 year to date budget summaries were reviewed.  Receipts for the period ending November 30, 2024, amounted to $55,936.87, cash balance on November 30, 2024, was $298,534.85.  The building permit and zoning permit logs were reviewed.  Supervisor Priebe stated he received a complaint about the midweek fireworks display at Big Rock Creek.

 

New Business:  The amendment to the Town’s zoning ordinance of two new special exception uses was reviewed and the second reading was had.  Priebe/Hall moved to approve Resolution 24-38 adopting Ordinance 24-03 amending Zoning Ordinance No. 1; motion carried on a unanimous roll-call vote, 4-0.

A RESOLUTION ADOPTING ORDIANCE 24-03

AMENDING ZONING ORDINANCE No. 1

WHEREAS the Town Board of the Town of St. Croix Falls has village powers under Section 60.10(2)(c), Stats., that grants police powers as set forth in Section 61.34(1), Stats., to act for the good order of the Town, for its commercial benefit and for the health, safety, and welfare of the public; and

WHEREAS the Town of St. Croix Falls adopted Zoning Ordinance No. 1 on August 5, 1965, amended in its entirely on May 12, 1994 and subsequent amendments including the amendments on March 20, 2001; January 16, 2008; February 18, 2009; May 20, 2009; October 21, 2009; March 17, 2010; April 21, 2010; August 18, 2010; March 16, 2011; April 20, 2011; October 19, 2011; November 16, 2011; August 21, 2013; March 18, 2015; March 15, 2017; June 20, 2018; October 17, 2018; January 16, 2019; March 20, 2019; October 16, 2019; December 16, 2020; July 21, 2021; March 16, 2022; November 16, 2022; April 19, 2023; November 15, 2023; and

WHEREAS the Town Board of the Town of St. Croix Falls deems it advisable and necessary to amend Zoning Ordinance No. 1, Chapter III – General Zoning, Section C, 3 – Commercial District with the addition of two new special exception uses for “retail of storage sheds, mobile homes, manufactured homes, and modular homes provided a permanent structure for retail sales and business shall be located on the property”; and “any other uses similar in character to the permitted or special exception uses in the commercial district provided a permanent structure for the retail sales and business shall be located on the property”; and

WHEREAS the Plan Commission of the Town of St. Croix Falls held a public hearing on the proposed amendments on November 13, 2024, the first reading of the proposed amendments was held on November 20, 2024, and a second reading was held on December 18, 2024.

THEREFORE BE IT RESOLVED that the Town Board of the Town of St. Croix Falls, Polk County, Wisconsin, does approve Ordinance 24-03 amending Zoning Ordinance No. 1, Chapter III – General Zoning, Section C – Districts, 3 Commercial District with the addition of two new special exception uses for “retail of storage sheds, mobile homes, manufactured homes, and modular homes provided a permanent structure for retail sales and business shall be located on the property”; and “any other uses similar in character to the permitted or special exception uses in the commercial district provided a permanent structure for the retail sales and business shall be located on the property”.

BE IT FURTHER RESOLVED that the Town Board of the Town of St. Croix Falls hereby petitions the Polk County Board of Supervisors to concur and ratify the amendments; and

BE IT FURTHER RESOLVED that Ordinance 24-03 become effective upon passage and publication and/or posting according to Wisconsin State Statute and approval of Polk County Board of Supervisors.

 

Ordinance 24-03

AMENDING ZONING ORDINANCE No. 1 ENTILTED “TOWN ZONING ORDINANCE”

ORDINANCE 24-03

Section 1:  Purpose

The purpose of this ordinance to amend:

Chapter III – General Zoning, Section C – Districts, 3 – Commercial District, c. – Special Exceptions, with the addition of:

“Retail of storage sheds, mobile homes, manufactured homes, and modular homes provided a permanent structure for retail sales and business shall be located on the property.”

And

Any other uses similar in character to the permitted or special exception uses in the commercial district provided a permanent structure for the retail sales and business shall be located on the property.”

Section 2:  Effective Date

This ordinance shall take effect from and after its passage, Polk County Board of Supervisors approval and legal publication.

 

Hall/Priebe moved to adopt Resolution 24-39 setting the 2025 caucus date for January 21, 2025, 7:00 p.m.; motion carried on a unanimous roll-call vote, 4-0.

A RESOLUTION SETTING THE DATE, TIME, AND LOCATION OF THE 2025 TOWN CAUCUS FOR THE TOWN OF ST. CROIX FALLS.

WHEREAS, the Town of St. Croix Falls uses the caucus method of nominating candidates to be placed on the 2025 Spring Election ballot, and

WHEREAS, Wisconsin Statutes requires the Town Board between December 1 and January 1 preceding this election to set the date, time, and location of the caucus and that the date set for the caucus be no sooner than January 2 and no later than January 21.

THEREFORE BE IT RESOLVED, that the 2025 caucus to nominate candidates for the 2025 Spring Election be held as follows:

Date:  January 21, 2025

Time: 7:00 p.m.

Town Hall

 

Hall/Bergmann moved to change the January town board meeting to Tuesday, January 21, 2025, 6:00 p.m.; motion carried.  Bergmann/Priebe moved to amend the Centuria Fire Department’s coverage area within the Town back to what existed on January 1, 2024; motion carried with Dorsey and Hall abstaining.  Hall/Bergmann moved to adopt Resolution 24-40 for auto aid from the City of St. Croix Falls Fire Department for all calls except first responder calls in the Centuria Fire Department’s coverage area within the Town of St. Croix Falls; motion carried on a unanimous roll-call vote, 4-0.

A RESOLUTION FOR AUTO AID FROM ST. CROIX FALLS FIRE DEPARTMENT FOR ALL EMERGENCY CALLS, EXCEPT FIRST RESPONER CALLS, IN THE CENTURIA FIRE DEPARTMENT COVERAGE AREA LOCATED IN THE TOWN OF ST. CROIX FALLS

WHEREAS, the Village of Centuria Fire Department (“Centuria Fire Department”) will be providing fire service to Sections 1, 2, 3, 4, 9, 10, 12, 13, 14, 15, 22, 23,  and 24, T34N, R18W  in the Town of St. Croix Falls (“Centuria FD Coverage Area”); and

WHEREAS, the Town of St. Croix Falls, desires that when the Centuria Fire Department receives a page for emergency services (not including First Responder calls), in the Centuria FD Coverage Area, that the City of St. Croix Falls Fire Department shall also be paged automatically, to provide automatic aid.

NOW, THEREFORE, BE IT RESOLVED that for all emergency calls in the Centuria FD Coverage Area, except First Responder calls, at the same time that the County pages the Centuria Fire Department, it will also automatically page the City of St. Croix Falls Fire Department on an “auto-aid” basis.

 

Legal Counsel presented an easement agreement for 2201 US Highway 8.  Hall/Priebe moved to approve the easement agreement for 2201 US Highway 8; motion carried on a unanimous roll-call vote, 4-0.  Hall/Bergmann moved to close the Town’s tax account with First Resource Bank; motion carried.  The five year road plan was reviewed for the next five years.

No closing public comment was had.

The January town board meeting will be held on January 21, 2025.  There being no further business, Hall/Bergmann moved to adjourn the meeting; motion carried and the meeting was adjourned at 6:50 p.m.
